THE Lusaka Magistrates Court has set December 26,  as judgment date for former Zambia Railways Limited (ZRL) chief executive officer Clive Chirwa and his former finance and administration director, Regina
Mwale.
Lusaka principal Magistrate Obister Musukwa set Boxing Day as judgment day after the two closed their defence in a matter they are charged with abuse of authority.
Chirwa is also charged with failure to disclose interest when he recommended his company Clavel Incorporated Limited to train ZRL staff.
Chirwa is in the second and third count jointly charged with Mwale for abuse of authority after the two allergy authorised payments of more than K144,000 which was beyond Chirwa’s accommodation entitlement.
Mwale who was the last person on stand told Mr Musukwa that she could not seek the permission of the board in the payment of Chirwa’s accommodation because he had already signed a contract.
The contract had entitled Chirwa to a five star hotel accommodation and consulting the board would have been a repetitive action.
Mwale said the contract that Chirwa signed with ZRL took into account the conditions of service for ZRL employees.
After closing her defence, Mr Musukwa ordered that she and Chirwa file in their written submissions by November 7, 2014.
The State said that it would rely on the evidence before court but Mr Musukwa allowed them to file in their submission by November 18, 2014 should they change their mind.
Mr Musukwa will deliver his judgment a day after Christmas on December 26, 2014.
