THE Kitwe High Court sentenced a man of Chingola to 30 years imprisonment with hard labour for defiling a 15-year-old girl after abducting her.
High Court Judge Chilombo Phiri sent to jail Martin Chipasha, 35, who defiled the girl between December 3 and 4 last year.
In sentencing Chipasha, Ms Justice Phiri noted that the convict abducted the girl and defiled her all night until 12:00 hours the following day.
The prosecution had proved the case against the accused person and that there was no evidence as to why the girl would falsely implicate him.
Ms Justice Phiri said it was saddening that Chipasha conducted himself in such a manner.
The girl had testified that on the fateful day, she was sent to the market by her sister when she met the accused person who held her by the hand.
She said Chipasha covered the girl with a piece of cloth on her mouth and face and led her to an unknown destination.
The court heard that the girl was taken to a house, laid on the bed and defiled four times in the night until 12:00 hours the following day.
She testified that the accused person had sex with her, while her face was still covered.
The court heard that in the afternoon, the girl’s face was uncovered and that she had the opportunity to look at his face.
She testified that after her ordeal, she noticed that her private parts were swollen and painful.
The girl reported the matter to the Police and Chipasha was arrested and charged with defilement.
