A TWENTY-ONE-YEAR-OLD taxi driver of Wusakile Township in Kitwe has been sentenced to death for brutally stabbing a man to death.

High Court Judge-in-charge Catherine Makungu sentenced Ivyn Musonda popularly known as ‘Besa’ to death by hanging after finding him guilty of causing the death of Sydney Musonda on June 2 last year.

Mr Musonda was brutally stabbed with a knife leaving his intestines protruding.

Martha Manase, 17, a school leaver, had testified that on the fateful day, her friend Sydney Musonda , 24, was  murdered after escorting her home.

Martha, also of Wusakile Township, said on the material day she was with the deceased at the show grounds in the company of two other friends and later they all went for a function at a named drinking place.

Afterwards around 19:00 hours, Martha and the deceased left the drinking place and headed home and when they reached the gate, they saw a Toyota Spacio heading in their direction.

The court heard that three men disembarked from the car and started harassing the deceased. They asked him why he was standing with Martha at the gate, and who she was to him.

Martha told the court that she ran inside the house and around 23:00 hours, one of the deceased’s friends went to her house with police officers and informed her that Mr Musonda  had been stabbed with a knife in the stomach.

In her Judgment, Ms Justice Makungu said the prosecution had proved the case beyond reasonable doubt and that there were no extenuating circumstances in the case.

She said Musonda acted with malice aforethought because he knew that stabbing someone was an illegal act that would cause injury or death to the victim.
