LUSAKA business executive, Aaron Chungu has sued Inter-market Bank Corporation for damages after unleashing bailiffs on his farm forcing him not to harvest his maize as the property is under the bank’s control.
Mr Chungu, who jointly sued with Bedrock Estates Limited, contended that he had planted maize on a 30-acre land on farm number S/D D of S/D 32 of 298a at a time the bailiffs pounced and placed a restriction order.
The plaintiffs were now claiming a declaration that the execution of the writ of possession on S/D D of S/D 32 of farm number 298a and S/D E of the S/D 32 of farm number 298a was wrongful.
Mr Chungu said he had suffered damages through mental distress and humiliation and loss of yield for his maize.
He said Inter-market had dragged Milda Investment who owned the remaining extension of S/D 32 of farm number 298a in 2014 involving a bank loan and when he failed to clear the loan, the bank was issued with a writ of possession.
He said he had spoken to the bank’s representative Bruce Mweemba who had accompanied the bailiffs to the property, informing them that they had entered a wrong property as he had no loan with Inter-market Bank.
Bedrock then made numerous telephone calls to Inter-market senior officials who declined to speak to them even after being informed that they were not privy to the action being taken and that the execution was misdirected.
The plaintiffs said the defendant had sufficient information and warning prior to the execution of the writ of possession but chose to proceed disregarding the wrong address and in total disregard of the second plaintiff’s plea.
They were also claiming for damages for wrongful execution on the plaintiff’s property and trespass.
