THE Lusaka magistrate court has granted Lusaka lawyer, Nchima Nchito a K10,000 bail after it cancelled a warrant of arrest issued against him for the alleged offence of personating.
Lusaka principal magistrate Greenwell Malumani said in his ruling yesterday that he was granting Nchito, a State Counsel , a K10,000 bail but in his own recognisance.
Mr Malumani also ordered Nchito to provide two sureties who would be bound in the like sum but in their recognisance.
This was after he canceled an arrest warrant which was issued against Nchito following a complaint by former Post Newspaper Limited (in liquidation) employee, Abel Mboozi.
Mr Mboozi complained to the court that Nchito ,  was personating as an advocate of the post newspapers (in liquidation) when his services were terminated by the newspaper’s liquidator Lewis Mosho.
This followed an order of the Lusaka High Court to place the newspaper under liquidation and appointed Mr Mosho as a provisional liquidator.
Mr Mboozi and four others had asked the High Court to wind up the Post Newspaper Limited on grounds that it had no capacity to pay its creditors.
But  Nchito on Thursday asked Mr Malumani to cancel the warrant of arrest against him arguing that there was no need for such because he was willing to present himself to the court without force.
After hearing from both Nchito and Mr Mboozi, Mr Malumani used his discretion to cancel the arrest warrant and granted Nchito bail. Nchito will appear in court on Monday
