A TWENTY-YEAR-OLD man of Chibombo District has denied defiling a minor but admitted having consensual sex with her because she was his girlfriend.
Enock Mvula and Amos Mwinga of Chibombo District appeared before Kabwe magistrate Temwani Mhango facing a defilement charge.
Mvula and Mwinga are alleged to have had sex with the minor.
Mvula narrated that on April 2, this year around midnight as he was returning from a drinking spree with his friend Mwinga, they branched off to see his girlfriend who had told him earlier that she was not feeling well.
Mwinga remained by the roadside as Mvunga approached the girlfriend’s house and after calling out her name, she came out and they chatted for a few minutes near her house.
A few minutes later, he heard someone throw a stone at him after which he told his girlfriend that the two should part company for fear of being stoned.
Mvula and his friend then left for their separate homes and were surprised the following day when Police picked them up accusing them of defilement.
During cross-examination when asked whether he had sex with the girl on the night, Mvula said he did not but that he had previously had sex with the girl on several occasions as she was his girlfriend.
Mwinga told the court that he escorted his friend to see his girlfriend and that he waited at a distance before Mvula returned to tell him that there were people throwing stones at him and advised that they leave.
Mwinga told court that he was also shocked that the following day around 07:00 hours some teachers apprehended him from his house and took him to the head teacher’s office at Muundu Primary School before taking him and his friend to Prospect Police Station.?? Ruling in the matter has been set for May 4.
