CHISAMBA Lungu’s case yesterday failed to take off because of miscommunication on dates when the player was due to appear before the Kitwe magistrate’s court.
Chisamba, a Buildcon player, is charged with one count of threatening violence, contrary to the Laws of Zambia.
Particulars of the offence are that Chisamba, 27, on March 23, 2018 with intent to cause alarm to Derrick Chama whom he threatened with the view to cause injury after he apparently said “I am shooting you with this gun”.
But when the matter came up for plea before Magistrate Kampinda Chipamu, Chisamba’s lawyer Kunda Iven Mulenga, of Iven Mulenga and Company, said his client was unable to attend court yesterday because he was wrongly informed by the police about the date of his court appearance.
Mulenga explained that his client, who is on police bond, was summoned to appear on Monday, rather than Tuesday, causing him to miss the session.
“Your honour there was too much confusion in this case involving my client. He was summoned on Monday to appear before court but his case didn’t come up. He couldn’t come today (yesterday) because it was short notice and we thought we can seek an adjournment so that he concludes his other engagements,” he said.
However magistrate Chipamu warned Mulenga not to bring such confusions to the court.
She said court was not a venue of confusion and advised him to deal with the confusion at Kitwe’s Central Police.
“I don’t expect such confusion here and deal with those confusions you are talking about at Kitwe Central Police. Neither this court nor the Magistrate court as a whole is of confusion,” she said.
Magistrate Chipamu adjourned the matter to April 4, 2018 and emphasised that Chisamba should appear.
