THE inter-parte hearing in a matter in which PF national chairperson Inonge Wina has challenged the declaration of another PF party president as well as candidate for the January 20, 2015 presidential election yesterday failed to take off.
Lusaka High Court Judge Mungeni Mulenga, who on Monday granted Ms Wina an ex-parte injunction stopping the holding of a second PF general conference other than that which elected Defence and Justice Minister Edgar Lungu was yesterday expected to hear arguments from both sides.
However, PF secretary general Bridget Atanga, who has been sued on behalf of the PF by Ms Wina, did not show up in court.
When the matter came up for hearing in chambers yesterday, one of the lawyers representing Ms Wina, Sukwana Lukangaba from Mweemba Chashi and Company requested to have the matter adjourned, saying some events had taken place after the ex-parte injunction was granted to his client.
Despite Ms Justice Mulenga granting Ms Wina an injunction ordering Ms Atanga or her agents not to hold the second general conference, the meeting went ahead and saw the election of Matero Member of Parliament (MP) Miles Sampa as PF president.
Mr Lukangaba also told the court that he was unable to file an affidavit of service (document which shows that Ms Atanga was served with the court document) on the court file because the lawyers were travelling from Kabwe where they had gone to serve the injunction.
He said the adjournment would also enable him to file the affidavit of service on court record.
Ms Justice Mulenga adjourned the matter to Friday and advised Ms Wina’s lawyers to inform the other parties about the adjournment.
Ms Justice Mulenga’s order, which was accompanied by a penal notice warning Ms Atanga about being liable for contempt of court proceedings if she ignored the court order, further restrained her from convening, gathering, nominating, adopting or electing any other candidate other than Mr Lungu.
It also stopped her from announcing, publishing or declaring any candidate as party candidate other than Mr Lungu who was allegedly elected on Sunday.
