Ndola High Court Judge in Charge Jane Kabuka convicted Robson Mwanza of 11 Peridge, Minsundu Township in Ndola after he pleaded guilty to manslaughter.
On October 15, 2014 Mwanza unlawfully cause the death of Webster Mwalwembe.
On October 6, 2014 around 09:00 hours, Mwanza, an employee of Kanel Mwale, went for work where he was chatting with the maid of the house and a man only identified as Mwelwembe went to the house and a fight ensued.
Mwanza later used a golf stick and hit Mr Mwelwembe and he sustained injuries on the lower lip and the head while Mwanza sustained an injury on his head.
They were both taken to Ndola Central Hospital where Mr Mwelwembe died and Mwanza was later discharged.
When the matter came for commencement of trial, Mwanza pleaded guilty to manslaughter.
In mitigation, Senior Legal Counsel Ethel Banda said Mwanza was remorseful of his actions and was seeking forgiveness from both the Court and the family of the deceased as he was a married man with four children.
Mwanza had learnt not to get involved in a fight again because it does not solve anything and that he also promised not to commit a similar offence or any other.
Ms Justice Kabuka noted that she had taken into consideration Mwanza’s mitigation and that a life was lost and post mortem revealed that it was as a result of head injuries.
