Separatees withdraw case against AG

MORE than 3,000 members of the Voluntary Separatees Association (VSA) have withdrawn their case against the Attorney General where they were claiming various payments from the Government.
In a notice of withdrawal, the members indicated they had decided not to be part of the case against the Attorney General and wished to be formally misjoined from the proceedings as they wanted to pursue their interests with the Government.
“That we have given instructions to our lawyer Rabson Malipenga and Company as our advocate to misjoin us from these proceedings, also take note that as the association or individuals that we have not given any instructions to Messrs Kumasonde Chambers to represent us herein,” read the notice.
In an affidavit signed by the secretary general Simemeza Syachoke, they stated that they took the legal action against the Attorney General in 2002 under the name of Nasando Isikanda as chairperson of the association and engaged Mr Malipenga in 2014 to represent them.
He said unfortunately, Mr Isikanda died in October 2012 and on August 14 this year, Mr Syachoke was replaced as chairperson and clarified that Bornell Kamoyo who sued the Attorney General this year over the same had never been instructed by members to do so.
“That we as the 3,046 plaintiffs have decided not to be part of this case against the Attorney General and we wish to be formally misjoined from these proceedings as we are pursuing our interests with the Government,” he said.
