FOOTBALL administrator Gideon Kaumba has accused Football House of breaching the Football Association of Zambia (FAZ) constitution by sneaking in a clause on Club Licensing without following procedure.
But FAZ Club Licensing manager Erick Mwanza said assertions by some people that Football House sneaked a clause into the constitution on Club Licensing were lies and had no basis.
The constitution that was circulated during the reconvened annual general meeting (AGM) in Lusaka in October saw a new clause incorporated as Article 45 A on Club Licensing when the past constitution only had Article 45 (judicial bodies) and Article 46 (Disciplinary Committee).
Kaumba in an interview yesterday said the inclusion of article 45 A was illegal and a breach of the FAZ constitution.
He wondered how Football House could sneak a clause in the constitution when it could be easily amended through the right procedure.
Kaumba said he haboured no hatred towards the Kalusha Bwalya led executive committee but was just not happy with the manner issues were being handled.
“In the first place,
I don’t understand why FAZ should sneak a clause in the constitution.
It is an offence.
There is nothing that stops them from amending the constitution using the normal procedure. FAZ is supposed to appoint a committee and bring the proposal to the AGM for approval,” he said.
According to the FAZ constitution Article 54, (1) only a FAZ AGM may amend the constitution and (2) a proposal of amendment of constitution may only be put to a vote at AGM by a Member after due notice has been given in accordance with the constitution.
He said that the last time the FAZ constitution was amended was in 2006 and that Club Licensing was not heard of at that time.
“The circulated constitution is illegal ,the last time the constitution was amended was in 2006 under Teddy Mulonga and Club Licensing was not heard of then and if there is an argument (with FAZ) that the constitution was amended how would it still have the names of Mulonga and former general secretary John Musonda?,” he wondered.
Kaumba added that the current executive have made it hard for some councillors to continue trusting in their leadership.
However, Mwanza said the secretariat at Football House merely implemented the clause into the constitution as it was amended during the AGM held in Kabwe last year.
Mwanza said Club Licensing was enacted into law at the AGM held in Kabwe in March last year and that all the secretariat did was to implement.
“Everything that is in the FAZ constitution is enacted by the councillors and nobody else.
The club licensing was enacted into law in Kabwe at the AGM and what the entire secretariat does is just to implement,” he said.
Mwanza said that statements by some people that FAZ sneaked in a clause were lies and have no grounds.
“These rumours going round on social media that FAZ sneaked in a clause in the constitution are mere chat and are not true.
The Club Licensing law was enacted into law without any objection and there was no need for a notice to circulate for it to be in constitution,” he said.
Mwanza said the people circulating lies do not attend AGMs and have no understanding of what is happening at such gatherings.
