A CHINESE business executive has sought protection of the Lusaka High Court alleging continued disturbances from his landlord on the property he rented from him off Kafue Road in Lusaka.
This is in a matter in which Wang Mioa has sued his landlord Victor Banda accusing him of locking the warehouse and restraining him from gaining entry to the premises.
Mr Wang wants the Lusaka High Court to order Mr Banda to immediately open the warehouse on plot 1152, off Kafue Road.
He wants an order restraining Mr Banda or his servants and agents from evicting him from the premises or harassing him and interfering with his quiet enjoyment of the place.
He further wants the court to declare that Mr Banda is in breach of the conditions and covenant under the lease agreement entered between the two on November 1, 2015.
He alleges that on November 1, 2015, Mr Banda leased his warehouse to him and he paid K96,000 rentals in advance.
Mr Wang who has co-sued with his company Green Oasis Haulage Limited further alleges that Mr Banda later approached him and asked if he could keep some of his belongings in the warehouse and to which he accepted.
But on December 5, 2015, Mr Wang discovered that 45 bags of cement which he had kept in the warehouse had gone missing and only him and Mr Banda had access to the place.
He said when he asked Mr Banda about the missing bags of cement he allegedly got angry and locked up the place and threatened to evict him.
Mr Wang said Mr Banda continuously interfered with his right to quiet enjoyment of the warehouse and threatened to permanently restrain him from accessing the place.
He said that because of Mr Banda’s conduct, he has failed to carry out business from the premises and will suffer irreparable damage if the court does not grant him an injunction.
