‘Form tribunal to probe DPP’

CIVIL rights activists Brebner Changala has written to President Edgar Lungu asking him to constitute a tribunal to probe criminal allegations leveled against the Director of Public Prosecution (DPP) Mutembo Nchito.
He said the issue of appointing Mr Nchito as DPP has been a dividing and controversial subject for the last three years because he has been seen as a hired gun to fix real or imaginary political fallouts.

Mr Changala indicated in his letter dated February 16 to Mr Lungu that he had written the same letter to the late Mr Michael Sata in 2012, saying the country could not have found itself in the ‘embarrassing judicial mess regarding Mr Nchito’s appointment.
“In order for us as a country to put the matter of the current DPP to rest once and for all, there is need for you to constitute a tribunal for Mr Nchito, this will allow him to come clean on all allegations that are being put forward by many Zambians,” Mr Changala said.
Mr Changala said the tribunal should probe Mr Nchito on the case of National Airports Corporation (NAC) versus Mine Air Services which traded as Zambian Airways, where the airline received US$1,020,788.08 as passenger service charges on behalf of NAC and had allegedly not been settled.
Mr Changala said the tribunal should also probe Mr Nchito on properties bought from Meridien Bank, where the current speaker Patrick Matibini is believed to have handled the transaction and therefore should have known the owner and the source of the money where he was at some point a partner.
“The question that begs answers is, did Mr Nchito as Task Force prosecutor get any property purchase information from Mr Matibini and if he did, what is that information as regards ownership of Tedworth Properties, how can Mr Nchito again seize Tedworth properties when it was never a subject of investigations?” he asked.
Mr Changala said most important is that the seized properties’ profits have not been accounted for to date and are believed to have been stolen by those who handled the said properties.
He said the assets at Access Financial Services AFSL being the subject of corruption should have been forfeited to the State under the Anti-Corruption Commission amounting to K17 billion.
“Your Excellency Sir, AFSL and Access Leasing Ltd are believed to have been looted while at bank of Zambia through padded legal fees and liquidation fees, this fraud was carefully planned and executed within the Task force on corruption, later on they wanted to suppress this evidence of criminal conduct,” he said.
Meanwhile, Lusaka High Court judge Mwila Chitabo has stayed any attempt to arrest Director of Public Prosecutions (DPP) over allegations of abuse of authority and professional misconduct.
But the complaint lodged to the Subordinate court by former deputy minister of Finance Newton Nguni against Mr Nchito’s alleged professional conduct, abuse of authority and other offences has since
been allocated to Lusaka magistrate Lameck Mwale.
Chongwe Magistrate Mutumba Phiri on Wednesday issued a warrant of arrest against Mr Nchito but the DPP, through his brother Nchima, obtained a stay pending a judicial review hearing on whether Mr Phiri was in order to issue the warrant.
Mr Justice Chitabo on Thursday ruled in favour of Mr Nchito and declared the warrant of arrest issued by Mr Phiri null and void and of no legal effect because the Chongwe magistrate court has no jurisdiction over wrongs Mr Nchito is alleged to have committed in Lusaka.
